Massachusetts on Tuesday officially became the first US state to ban — if temporarily — the sale of all electronic cigarettes, going further than states that only prohibited flavored products.

The ban is effective immediately and will run until January 25, said Governor Charlie Baker, who declared a public health emergency in the northeastern state.

San Francisco in California had already adopted a similar citywide ban in July, but until now no other state had imposed a statewide ban.

“The purpose of this public health emergency is to temporarily pause all sales of vaping products so that we can work with our medical experts to identify what is making people sick and how to better regulate these products to protect the health of our residents,” Baker said.

In the past weeks a wave of severe vaping-linked pulmonary diseases that has sickened hundreds and caused seven deaths have been reported in the United States, according to the Centers for Disease Control and Prevention (CDC).

A central California man is the 7th to die from a severe lung illness linked to vaping, according to the Centers for Disease Control and Prevention. Forty-four state health has reported investigations into over 500 possible cases of vape-related illness.

The surge in cases prompted the CDC to activate its emergency operations center, allowing CDC officials to allocate additional staff and resources to the nationwide investigation.

In response, a leading online distributor of CBD products has announced they have removed vaping pens from their website effective immediately.

CBDOils.com co-founder and retired U.S. Army Major Richard Ojeda says that although there is no known connection between CBD vaping pens sold on their site and the illnesses and deaths, they’re stopping sales immediately out of an abundance of caution, and to avoid being confused with other, less reputable distributors.

Ojeda, the former West Virginia State Senator who gained national notoriety during his hard-charging and highly publicized 2018 campaign for United States Congress, said that many of their customers are fellow veterans.

“We know that CBD in different forms has helped thousands of my fellow veterans with pain management, PTSD, anxiety, and other issues. We will still provide CDB to veterans and others in a variety of other forms including capsules, creams, gummies, tinctures and more. But, we’re stopping the sale of these vaping pens right away to avoid being lumped in with these shady companies out there who have absolutely no conscience and are just trying to make a fast buck, no matter the consequences. I’m not going to stand for it when it comes to our customers, especially our veterans. They deserve better.”

An Associated Press report recently found that some operators have cashed in on the CBD craze by substituting cheap, illegal synthetic marijuana or worse for harmless natural CBD in their vapes.

That has sent dozens of people of to hospital emergency rooms. Ojeda says that “some of the crooks behind these spiked products have gotten away with it, because the business has boomed so fast that regulators haven’t caught up.” He says that all the products at www.cbdoils.com go through a rigorous vetting process before being sold there.

The Associated Press commissioned testing of thirty vape products sold as CBD around the country, focusing on brands that authorities or users flagged as suspect. One third contained types of synthetic marijuana (commonly known as K2 or spice) that have no known medical benefits, while others had no CBD at all.
